Booking Form And Contract
Please make sure you read through my terms and conditions at the bottom of the page and contact me if you have any questions before completing and submitting the form.
Once I have received your form and you’ve agreed to my terms and conditions, together with your non refundable booking fee, your date is saved and booked.
TERMS AND CONDITIONS
It is agreed that the terms set out in this booking form is the total agreement made between the parties and that no variation or modification of this contract shall be effective unless agreed by both parties in writing.
RESERVATION: Upon your signature, Juliet McKee Photography will reserve the time and date agreed upon, and will not make other reservations for that time and date. For this reason, the Reservation Deposit is non-refundable, even if the date is changed or the wedding cancelled for any reason. The reservation deposit is to be paid at time of signing the contract. The Reservation Deposit is applied towards the contracted wedding photography package. The client(s) understand(s) and agree(s) that the entire amount owed for the wedding photography package described in the contract is due not less than 28 days before the wedding day.
The client understands and accepts that the photographic coverage will be as the photographer’s professional expertise determines and that no one photograph will be deemed more important than another. Special requests are not binding instruction, although every effort is made to comply with the client’s wishes. Any special requests not notified on this booking form must be made by the client to the Photographer/s in writing.
Meal & Refreshments The client will provide refreshments (cold drinks), and a hot meal if coverage is greater than 6 hours, for the photographer/photographers to be served during the wedding breakfast when the photographer/photographers will take their break.
It is the responsibility of the client to ensure the co-operative behaviour of guests at an event. Juliet Mckee Photography reserves the right to terminate coverage and leave the location of the event if the photographer/s experience inappropriate, threatening, hostile or offensive behaviour from person(s) at the event; or if the safety of the photographer/s from Juliet Mckee Photography is in question. Where coverage is terminated for these reasons no refund shall be given.
All image sizes are nominal. The photographer/s will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials especially man-made fibres. It is sometimes Impossible to record on film/digital the exact colour as seen by the human eye.
The photographer will perform a standard amount of retouching to take the photographs to a quality of which she is proud.
Digital Files & Copyright
All photographs taken by Juliet McKee and her assistants are her property and will remain her property and are protected by UK Copyright law; These rights are asserted in accordance with sections 77 and 78 of Copyright, Designs and Patents Act 1988.
The digital download provided to The Client(s) contains high-resolution files for prints/products. The image files come with a license of usage for The Clients(s) This license is for personal usage only. This means non-commercial use of the image(s) for display on websites and computers, or making prints/products for personal use. The image(s) may not be used in any way whatsoever in which you charge money, collect fees, or receive any form of remuneration. The image(s) may not be entered into competitions or used in advertising. The image(s) may not be re-sold, re-licensed, or sub-licensed.
Copyright and all rights now and in the future, of and for the images(s) remain exclusively with ‘Juliet McKee Photography.’
The images are fully edited. No further editing is permissible using photography software etc. The user may crop their image(s) for their own usage.
There are no warranties, express or implied. The image(s) are provided ‘as is’.
Juliet McKee Photography, is not responsible for any prints that are not directly ordered from her nor will she be liable for any third party claims or incidental, consequential or other damages arising out of this license or buyer’s use of image(s).
Negatives/digital files remain the property of the photographer/s.
The photographer/s shall be granted complete artistic licence including in relation to the poses photographed and the locations used. The photographer/s’ judgment regarding the locations/poses and number of images taken shall be final. Due to the vagaries of the weather and the willingness of subjects it may not be possible to capture all the images requested.
Force Majeure or Act of God
The due performance of the work detailed above is subject to the photographer’s alteration or cancellation owing to any cause beyond her control. In the unlikely event of the photographer’s cancellation the following will apply; a) arrangements will be made for another photographer of comparable qualification to cover the event with agreed fees remaining unchanged. B) If this is not possible a full refund will be given of all monies paid to the date of cancellation.
If Juliet Mckee Photography has to cancel this contract for reasons beyond our control, our liability shall be limited to a full refund of monies paid. Every effort will be made to find a suitable replacement.
Should the client cancel, you will be liable to pay to us compensation based on a percentage of the total fee, depending on when notice is received:
*61 to 120 days: 50%
* 31 to 60 days: 75%
* 0 to 30 days: 100%
Limitation of Liability
In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.
The Photographer will make every effort to archive the images for 12 months. However, the Photographer makes no warranty about the nature of her archive past the date of the delivery of the first order. The Client should treat the delivered images carefully and in case of digital files it is recommended you keep a safe copy on your own devices.
Any complaints should be raised by the client with the photographer/s, in writing, within 28 days of first becoming aware of the matter to be complained of and in any event within 28 days of receipt of the images.
